1. Agreement to terms

These Terms of Use ("Terms") govern your use of QAL VPN services, websites, software, and applications provided by QAL VPN PTY LTD ("QAL VPN", "we", "our", "us").

By creating an account, downloading, or using QAL VPN, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the service.

2. Eligibility and account responsibilities

  • You must be at least 18 years old and legally able to enter a binding contract.
  • You must provide accurate account information and keep credentials secure.
  • You are responsible for activity under your account.
  • You must promptly notify us of unauthorized use or suspected compromise.

3. Service description

QAL VPN provides VPN connectivity, account and subscription management features, and optional post-quantum security functionality. Service availability and features may change over time.

We may add, remove, or modify features to improve security, performance, legal compliance, or operational stability.

4. Subscription, billing, and entitlement

  • Paid access is subscription-based and may include trial periods where offered.
  • Billing and subscription management are processed through Stripe.
  • Access to connect may depend on active entitlement status.
  • Fees, taxes, and billing cycles are shown at checkout.
  • Refunds are handled according to applicable law and stated policy.

5. Acceptable use

You must not use QAL VPN to:

  • engage in unlawful activity under applicable law;
  • distribute malware, phishing content, or abusive traffic;
  • attempt unauthorized access to systems or accounts;
  • interfere with service integrity, performance, or availability;
  • resell or sublicense service access without written authorization; or
  • circumvent billing, entitlement, or security controls.

6. Post-quantum feature disclaimer

QAL VPN may provide optional post-quantum cryptography features. This capability is intended to improve long-term confidentiality posture, but does not constitute a guarantee against all current or future attacks.

Cryptographic standards and attack models evolve. You are responsible for evaluating suitability for your own risk profile and regulatory obligations.

7. Availability and performance

We aim to provide reliable service but do not guarantee uninterrupted availability, specific throughput, latency, or region uptime. Network conditions, third-party infrastructure, and user environment can affect performance.

8. Intellectual property

QAL VPN retains all rights, title, and interest in the service, software, branding, and related materials, except where third-party software licenses apply.

You may not copy, reverse engineer, modify, distribute, or create derivative works except as permitted by law or written permission.

9. Suspension and termination

We may suspend or terminate access if:

  • you breach these Terms;
  • required by law, regulation, or court order;
  • activity threatens service security or other users; or
  • billing obligations remain unpaid.

You may stop using QAL VPN at any time. Termination does not remove obligations accrued before termination.

10. Warranties and limitation of liability

To the extent permitted by law, the service is provided "as is" and "as available" without warranties of uninterrupted operation, fitness for a particular purpose, or error-free performance.

To the maximum extent permitted by law, QAL VPN is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity.

Where liability cannot be excluded under Australian law, including the Australian Consumer Law, our liability is limited to remedies permitted by law.

11. Indemnity

You agree to indemnify and hold harmless QAL VPN, its directors, officers, employees, and agents from claims or losses arising from your breach of these Terms, misuse of the service, or violation of law.

12. Governing law and jurisdiction

These Terms are governed by the laws of Victoria, Australia. Subject to mandatory law, disputes are subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.

13. Changes to these terms

We may update these Terms from time to time. Updated terms will be published on our website with the revised effective date. Continued use after updates constitutes acceptance of the updated Terms.
